The Logan Act states:
Any U.S. citizen, wherever located, who initiates or conducts any correspondence or interaction, directly or indirectly, with any foreign government or any of its officers or agents, without the authority of the United States, with the intent to influence such action, or in connection with any dispute or controversy with the United States or for any action by the United States. Any act of a foreign government, or any officer or agent thereof, to invalidate any act shall be punishable under this title by a fine or by imprisonment for a term not exceeding three years. both.
This provision does not limit the right of a citizen himself or his representative to seek relief from a foreign government or its agents for damage suffered by such government or its agents or principals.
Donald Trump is a civilian. He has no authority to conduct foreign policy on behalf of the United States. Trump is interfering with and undermining American foreign policy by reposting old comments he made himself.
Trump thinks this is an example of projecting his power. He probably believes he is campaigning. But he is undermining the country's foreign policy and has no legal authority to do so.
At the very least, he is attempting to undermine President Biden's authority and interfere with the country's foreign policy. At worst, Donald Trump is a rogue operator who seeks to shape American policy by illegally breaking the law.
