I think my upcoming Texas Law Review The article “The Constitutional Case for Exclusionary Zoning” (co-authored with Josh Braver) serves in some ways to complement Bryan’s book. In the book, Brian suggests that judicial review “is probably the best way to go.” [at] It talks about ‘radical housing deregulation’ but doesn’t go into much detail. Braver and I explain how such judicial intervention could happen and why it should happen.
