What do the new Title IX regulations do?
According to a press release from the Department of Education, the new Title IX regulations include:
– Protect against all sexual harassment and discrimination. The final rule protects all students and employees from all gender discrimination prohibited by Title IX, including restoring and strengthening full protections against sexual assault and other sexual harassment. This rule clarifies the steps schools must take to protect students, employees, and applicants from discrimination based on pregnancy or related medical conditions. And these rules protect against discrimination based on sexual stereotypes, sexual orientation, gender identity, and gender characteristics.

– Encourage accountability and fairness. The final rule strengthens accountability by requiring schools to take immediate and effective action to end gender discrimination in their educational programs or activities, prevent its recurrence, and address its effects. The final rule requires schools to respond promptly to all gender discrimination complaints through a fair, transparent, and credible process that includes trained, unbiased decision-makers to evaluate all relevant and inadmissible evidence.
– Empower and support students and families. The final rule protects students, employees, and others who exercise their Title IX rights from retaliation. This rule requires schools to communicate anti-discrimination policies and procedures to all students, staff, and other participants in educational programs to ensure that students and families understand their rights. This rule supports the rights of parents and guardians to act on behalf of their children in primary and secondary schools. And the rule protects student privacy by prohibiting schools from disclosing personally identifiable information, with limited exceptions.
President Biden has gone beyond rolling back Trump's Title IX protections, including making it easier for schools and colleges to cover up sexual violence and weakening protections for people who face gender discrimination in all schools receiving federal funding. . Biden also expanded Title IX protections to include gender and sexual orientation.
Because executive actions can be overturned by the next administration, changes to Title IX raise questions for voters about what kind of society they want to live in.
