Presidents have operated throughout our nation’s history without the threat of criminal prosecution, except once. When President Biden took office, he claimed he had found both the authority and the obvious need to put his political rivals, past and future, in jail. That was unprecedented, and today the Supreme Court has made it clear that criminal law (i.e., legislative) cannot paralyze the executive.
