Radical liberal singer Cher broke down in court this week before a judge denied her request for temporary emergency guardianship of her 47-year-old son Elijah Blue Allman.
Cher breaks down in court
People Magazine reported that Cher, 77, couldn't help but feel emotional about her son's well-being after her lawyers expressed concerns about his health and safety. Her attorney told the judge she filed the request because of how serious she felt Allman's situation was, and that she wanted the money he owed from the trust to be handled and managed for his benefit, she said.
Cher's lawyer said “she feared her son would not be alive within the year” because of two ongoing issues: his “history of drug use” and his diagnosis of “schizoaffective disorder.” She also expects to receive a bipolar diagnosis for Allman from a 'leading doctor'.
“Cher was told by her doctor that if she did not take this action as a mother, he would end up back on the streets,” her lawyer said.

Allman disputed his mother's claim that he was receiving treatment for addiction, but Cher's attorney argued that she was more concerned about her son's history of mental illness.
“[Drug use] “It is the issue of mental illness that is secondary and makes Mr. Allman vulnerable,” they argued. “He is surrounded by people who deny the mental illness component.”
Cher's attorney also said Allman was covered by 5150 protections, a legal provision in California that “allows a mentally ill person to be involuntarily detained and admitted to a psychiatric hospital for 72 hours.” The most recent holdup was in September, when Allman, who was reportedly sober, experienced a “psychotic episode.”
“Your honor,” Cher's attorney said, adding, “We are trying to avoid a situation where Cher's life is in jeopardy. The Grammy Award-winning singer is very amenable and would fully agree to a third-party professional trust.” ”She was appointed Allman by the court.

Judge's Rules for Cher
But unfortunately for Cher, the judge ultimately denied her request.
“I don’t question Cher’s concern about her son. i don't think [Allman] The judge said there was “sufficient evidence” to agree to temporary conservatorship because most of the claims made by the singer’s lawyers were based on “fear” and hypotheticals.
“That in itself is not grounds for the court to appoint a probate guardian. As of today, I have not seen any evidence to grant temporary emergency guardianship,” the judge continued.
The judge concluded by saying Allman “managed his finances,” “had an apartment,” and was “drug-free” even after submitting to “multiple drug tests.”

Judge ends hearing – Allman celebrates
The judge ended the hearing, saying he would resume for a further hearing on March 6 because the proposed conservatorship case is still ongoing.
Allman immediately celebrated her legal victory over her mother.
“We were very pleased that Elijah did not need a temporary guardian, as the court determined. He thanks his fans, friends and community for their support. He is doing well,” his lawyer said. “We are looking forward to March. He's doing well. “He came here today.”
